By using this website, registering on it, or booking any of its services, you agree to be bound by these terms and conditions.

►Consulting services: All services provided through the platform, including industrial and economic consulting, management consulting, engineering and technical consulting, whether online or on-site.

►Consulting session: A virtual or in-person meeting between the consultant and the client to provide specialized professional advice.

►Specialized study: A detailed report or analysis prepared at the client's request addressing a specific topic in the industrial, administrative, or engineering fields.

►Consultant: Engineer Majed Albeaji or any certified expert working under the supervision of the platform.

►Account: The personal account created by the user on the platform to access services and manage bookings.

2. Acceptance of Terms and Conditions

►By using the platform, you acknowledge and agree to the following:

►That you have read and understood these terms and conditions in full.

►You have full legal capacity to enter into contractual obligations.

►If you represent a company or institution, you have full authority to bind that entity to these terms.

►You agree to abide by the privacy policy published on the website.

►You are fully responsible for any use of your account on the platform.

►The platform reserves the right to modify these terms at any time, and users will be notified of any material changes. Your continued use of the platform after the publication of the modifications constitutes your acceptance of the updated terms.

3. Registration and Account Creation

►3.1 Registration Requirements — To use certain services on the platform, you may be required to create a personal account. You must:

►Update your information immediately if any changes occur.

►Keep your login details (username and password) confidential.

►Notify the platform immediately if you suspect any unauthorized use of your account.

►3.2 User Responsibility — You are solely responsible for all activities that occur through your account. The platform is not responsible for any losses or damages resulting from failure to keep your login details confidential.

►3.3 The Platform's Right to Suspend Accounts — The Platform reserves the right to suspend or cancel any account in the event of:

►Providing misleading or inaccurate information.

►Violating any of these terms and conditions.

►Using the Platform for illegal or unethical purposes.

►Failure to pay for reserved services.

4. Services Provided

►4.1 Types of Services — The Mostashark platform provides the following consulting services:

►a) Industrial and Economic Consulting — Includes: Preliminary and comprehensive feasibility studies; Market and competition analysis; Supply chain assessments; Financial and economic studies; Return and risk modeling; Investment opportunity evaluation; Technical and financial RFPs formulation.

►b) Administrative Consulting — Includes: Organizational structure design; Business model and corporate strategy development; Policy and procedure formulation; Process automation through ERP systems; Startup and entrepreneur support; Administrative and digital transformation.

►c) Engineering and Technical Consulting — Includes: Design and engineering standards; Process solutions; Project and construction management; Environmental studies; Automation and control solutions; Value engineering and factory performance improvement.

►4.2 Service Delivery Methods

►a) Online Consultations — Virtual sessions via secure digital platforms. Session duration: 1 to 3 hours based on user selection. Price: Updated and announced on the platform. Includes: Screen sharing, session recording (if possible), written recommendations.

►b) Onsite Consultations (Field Visits) — Consultant visit to client's site or work environment. Comprehensive assessment of operations, systems, and procedures. Practical solutions supported by field experience. Price: Customized based on project scope and requirements.

►c) Specialized Studies — Detailed analytical reports prepared per client request. Price and timeline: Agreed upon based on study scope and complexity through detailed technical and financial proposal.

►4.3 Service Limitations — Services provided are consultative in nature and do not constitute a final binding decision. The consultant provides professional opinion based on available information and accumulated experience. The client is solely responsible for making and implementing final decisions. The platform does not guarantee specific outcomes or certain financial returns as a result of applying recommendations.

5. Booking and Payment

►5.1 Booking Process — Sessions or services are booked through the website by filling out dedicated forms. The client must specify the type of service required and the suitable appointment. All bookings are subject to platform confirmation within 24 business hours. If the booked appointment changes, the client will be contacted to propose alternatives and provide reasons.

►5.2 Prices and Fees — All prices displayed on the website are in Saudi Riyal (SAR). Prices do not include Value Added Tax (VAT) unless otherwise stated. The platform reserves the right to modify prices at any time without prior notice. Applied prices are those in effect at the time of booking confirmation.

►5.3 Payment Methods — Payment is made through available electronic means on the website. Payment must be completed in full before the session or service execution begins. For specialized studies, the user commits to the payment terms mentioned in the financial proposal sent to them.

►5.4 Invoices — An electronic invoice will be issued for each payment transaction and sent to the registered email. The invoice includes service details, paid amount details, and payment date.

6. Cancellation and Refund Policy

►6.1 Client Cancellation — For Online Consultations: Cancellation 48 hours or more before session: full refund. Cancellation 24-48 hours before session: 50% refund. Cancellation less than 24 hours before session: no refund.

►For Field Visits: Cancellation 7 days or more: 80% refund. Cancellation 3-7 days: 50% refund. Cancellation less than 3 days: no refund.

►For Specialized Studies: If work on the study has started, no refund is possible. If work has not started, advance payment can be refunded after applying 15% deduction from the advance amount.

►6.2 Platform Cancellation — In exceptional cases (consultant illness, force majeure), the platform may cancel the session. The client will be notified immediately. An alternative appointment will be proposed or full refund provided. The platform bears no responsibility for any indirect damages resulting from cancellation.

►6.3 Refund Procedures — Refund requests are processed within 7-14 business days from approval date. Refund is made using the original payment method. Bank processing fees beyond the platform's control may apply.

7. Client Obligations

►The client commits to the following:

►7.1 Providing Accurate Information — Provide correct and complete information when registering or booking services. Supply the consultant with all necessary information and documents for effective service delivery. Not withhold any material information that may affect the quality of consultation.

►7.2 Adherence to Schedules — Be present at the specified time for virtual or field sessions. In case of delay exceeding 15 minutes without prior notice, the platform reserves the right to cancel the session without refund.

►7.3 Professional Conduct — Deal with courtesy and respect with the consultant and team. Not use services for illegal or unethical purposes. Not record sessions without prior consent from the consultant.

►7.4 Confidentiality — Maintain confidentiality of any information, methodologies, or tools shared by the consultant. Not publish or distribute consulting content without prior written permission.

8. Platform and Consultant Obligations

►The platform and consultant commit to the following:

►8.1 Professionalism and Quality — Provide consulting services with the highest standards of professionalism and quality. Adhere to specified schedules for sessions and deliveries. Provide recommendations based on practical experience and accurate analysis.

►8.2 Confidentiality — Maintain confidentiality of all information exchanged with the client. Not share any client-specific information with third parties without written consent. Use information only for the purpose of providing the requested service.

►8.3 Transparency — Clarify service scope and realistic expectations before starting. Inform the client of any limitations or challenges that may affect service delivery.

9. Intellectual Property

►9.1 Website Content — All content published on the website, including texts, images, logos, designs, icons, and software, is the exclusive property of Mostashark platform or licensed to it. It is prohibited to:

►Copy, reproduce, or distribute any content without prior written permission.

►Use content for commercial purposes without licensing.

►Modify or alter any content in a way that may harm the platform's reputation.

►9.2 Consulting Outputs — Reports and studies prepared specifically for the client become their property after full payment. The consultant reserves the right to retain a copy for internal archiving. The client may not resell or license consulting outputs to third parties without platform approval. Methodologies, tools, and frameworks used in providing consultation remain the consultant's intellectual property.

10. Limitation of Liability

►10.1 Nature of Consultative Service — Services provided are consultative in nature and represent professional opinion based on experience and available information. The platform provides no guarantees regarding specific outcomes or certain financial returns. The client bears full responsibility for decisions made based on the consultation.

►10.2 Liability Limitations — To the maximum extent permitted by law, the platform or consultant bears no responsibility for: Any indirect, incidental, or consequential damages resulting from service use; Loss of profits, revenues, data, or business opportunities; Any damages resulting from inaccurate or incomplete information provided by the client; Client decisions or implementation of provided recommendations.

►In all cases, the platform's total liability does not exceed the amount actually paid for the specific service.

►10.3 Exceptions — The above limitations do not apply to: Damages resulting from gross negligence or intentional misconduct by the platform; Obligations that cannot be excluded or limited under the law.

11. Confidentiality and Data Protection

►11.1 Mutual Commitment to Confidentiality — Both the platform and client commit to maintaining confidentiality of: All business, technical, or financial information exchanged; Details of consultations and recommendations provided; Any information explicitly identified as confidential.

►11.2 Exceptions — The confidentiality obligation does not apply to information that: Is publicly available without breach of this agreement; Is obtained legally from a third party without confidentiality obligation; Is required to be disclosed under law or court order.

►11.3 Personal Data Protection — Processing of personal data is subject to the privacy policy published on the website, which forms an integral part of these terms and conditions.

12. Force Majeure

►The platform bears no responsibility for delays or failures due to circumstances beyond its control.

►Includes: Natural disasters, wars, epidemics, internet service interruptions, legal changes.

►In case of force majeure, the platform will make reasonable efforts to notify the client and find alternative solutions.

13. Dispute Resolution

►Amicable Negotiation: Attempt to resolve any dispute amicably within 30 days.

►Mediation: If negotiation fails, recourse to mediation through a neutral agreed-upon party is possible.

►Arbitration and Litigation: Refer disputes to competent courts in Riyadh city, Kingdom of Saudi Arabia.

►Applicable Law: These terms are subject to the laws of the Kingdom of Saudi Arabia.

14. General Provisions

►14.1 Entire Agreement — These terms and conditions, together with the privacy policy, constitute the entire agreement between the parties and supersede any prior agreements or understandings.

►14.2 Severability — If any provision of these terms is found to be illegal or unenforceable, it does not affect the validity and enforceability of other provisions.

►14.3 Non-Waiver — The platform's failure to exercise any right under these terms does not constitute a waiver of that right.

►14.4 Modifications — The platform reserves the right to modify these terms at any time. Modifications will be posted on the website with the date of last update. Continued use of the website after modifications are posted constitutes acceptance of the updated terms.

►14.5 Assignment of Rights — The client may not assign their rights or obligations under these terms without prior written consent from the platform.

►14.6 Language — The Arabic version of these terms is the official and binding version. In case of any conflict between the Arabic version and any translation, the Arabic version shall prevail.

15. Acknowledgment and Consent

►By using the Mostashark platform, you acknowledge that you:

►Have read and fully understood these terms and conditions.

►Agree to comply with all the terms and provisions contained therein.

►Have full legal capacity to enter into this agreement.

►Understand that the services provided are consultative in nature and do not constitute a guarantee of specific outcomes.
